Criminal Law

Criminal law is the #1 area of practice for Gregory Kallen.  Mr. Kallen was an assistant Commonwealth’s Attorney in Wise and Dickenson Counties, and was the Commonwealth’s Attorney for Wise County.  Since going into private practice in 2000, he was added to the list of certified capital defenders and was involved in 9 capital cases, along with the defending numerous cases in federal court in the Western District of Virginia.  He is also admitted to practice in the Eastern District of Tennessee Federal Court.  He was also appointed by two governors to the State Board of Corrections, and taught corrections, among other courses at the University of Virginia’s College at Wise. 

Domestic Relations

Mr. Kallen does custody, divorce, adoptions, and support cases. He serves as guardian ad litem in several courts, representing children in juvenile court. He served four years as the attorney for the Wise County Department of Social Services, and has successfully challenged social services departments in both the courts and administrative hearings. As someone who raised his children after a divorce, he understands the emotional pain of divorce, and endeavors to encourage people to settle their differences amicably, but if that is not possible, he has done contested divorce litigation in several counties in Virginia.

Personal Injury

Although most of his jury trials have been criminal (over 100), the skills as a trial attorney are useful in his personal injury practice. In most cases, a fee that is a percentage of recovery is agreed upon, and the client pays nothing but court costs if not successful. Other terms can be negotiated. After the initial consultation, the client may be expected to bring documents that are requested, and then an agreement on representation is made. Although the statue of limitations is two years, prospective clients are urged to come in promptly, so the relevant records can be obtained before the filing deadline.

Wills & Estates

Mr. Kallen has prepared wills for over twenty years for various clients. As someone who has a deceased father and elderly mother, he is well aware of the pain involved in handling estates, as well as the necessity for proper planning so that the estate process runs smoothly. He taught the subject to paralegals at Mountain Empire Community College. There is no charge for an initial consultation. Every November, he does wills for veterans at 50% off, as a Veterans Day tribute. If you are active military, wills are always free, always have been, and always will be.
